Canada: No specific legislation; EDR data classified as diagnostic and non-private, though insurers typically obtain consent as standard practice.
United States: The federal Driver Privacy Act of 2015 (December 2015) regulates EDR data access, establishing ownership rights with vehicle owners/lessees. Seventeen states have enacted EDR privacy laws: Arkansas, California, Colorado, Connecticut, Delaware, Maine, Montana, Nevada, New Hampshire, New Jersey, New York, North Dakota, Oregon, Texas, Utah, Virginia and Washington. These jurisdictions generally require vehicle owner/policyholder consent for data extraction, with specific legal exceptions.
